1. Introduction
These Terms and Conditions ("Terms") govern your use of the Studify Tutors website and all tutoring services provided by Studify Tutors ("Studify", "we", "us", or "our"). By booking a session, submitting a free trial request, or using our website, you ("the parent", "the client", or "you") agree to be bound by these Terms.
Please read these Terms carefully before using our services. If you do not agree with any part of these Terms, you should not use our website or services.
These Terms should be read together with our Privacy Policy, which explains how we collect and use your personal information.
2. About Our Services
Studify Tutors provides personalised online one-on-one tutoring services for students in Grade 1 through Grade 12, covering the IEB, CAPS, and Cambridge curricula. All sessions are conducted remotely via Google Meet.
We match each student with a vetted tutor based on the student's curriculum, grade, subject(s), and learning needs. Tutors are independent contractors engaged by Studify and are not employees of Studify Tutors.
Our services currently operate in South Africa and all pricing is in South African Rand (ZAR).
3. Booking and Payment
3.1 How Booking Works
To book tutoring sessions, you must complete the booking form on our website, select a package, and make full payment. A booking is only confirmed once payment has been successfully received. No sessions will be scheduled until payment is confirmed.
3.2 Pricing
Our current packages and pricing are displayed on the website. All prices are in South African Rand (ZAR) and include all applicable fees. We reserve the right to change our pricing at any time. Any price changes will apply to new bookings only and will not affect existing confirmed bookings for the current month.
The current package rates are:
Bronze: 4 sessions per month at R190 per session (R760/month)
Silver: 8 sessions per month at R180 per session (R1,440/month)
Gold: 12 sessions per month at R170 per session (R2,040/month)
Platinum: 12 sessions per month at R280 per session (R3,360/month), including premium features
Single Session (Pay As You Go): R235 per session
3.3 Payment Method
All payments are processed online via Yoco, a PCI-compliant payment gateway. We accept Visa, Mastercard, and American Express credit and debit cards. We do not accept cash payments, direct bank transfers, or payment after sessions have been delivered, except where specifically arranged in writing.
3.4 Promo Codes and Discounts
Promo codes may be offered from time to time at our discretion. Promo codes must be entered during the booking process and cannot be applied retroactively to existing bookings. Promo codes may have expiry dates, usage limits, and other conditions. We reserve the right to cancel or modify any promotional offer at any time.
3.5 Invoices and Receipts
A confirmation email including payment details will be sent to the email address provided at the time of booking. This serves as your receipt. If you require a formal tax invoice, please contact us.
4. Tutor Assignment
After your booking is confirmed, we will assign a tutor who specialises in your child's curriculum, grade, and subject(s). We aim to complete tutor assignment within 24 to 48 hours of your booking.
While we make every effort to match your child with the most suitable tutor, tutor assignment is subject to availability. We do not guarantee a specific tutor unless expressly agreed in writing.
If you are not satisfied with the assigned tutor, you may request a tutor change at any time (see Section 7).
5. Session Scheduling
5.1 Scheduling
Sessions are scheduled based on the preferred days, time slots, and start date you provide during the booking process. Final session times are confirmed once a tutor has been assigned and their availability has been matched with your preferences.
Sessions are one hour (60 minutes) in duration unless otherwise agreed.
5.2 Session Delivery
All sessions take place via Google Meet. A Google Calendar invite containing the Google Meet link will be sent to both the parent/student and the tutor before each session. You are responsible for ensuring that your child has access to a device with a stable internet connection and a working camera and microphone.
5.3 Session Recordings
Sessions may be recorded via Google Meet for the purpose of allowing the student to review lesson content. By booking a session, you consent to the recording of sessions for this educational purpose. Recordings are only accessible to the student, the parent, and the assigned tutor. Recordings will not be shared publicly or used for any purpose other than the student's educational benefit without your explicit consent.
5.4 Weekend and Holiday Sessions
We offer sessions on weekdays and Saturdays, subject to tutor availability. Session scheduling is flexible and is arranged by mutual agreement between the parent/student and the assigned tutor.
6. Cancellation and Rescheduling Policy
This policy applies to all booked sessions across all packages.
6.1 Rescheduling
You may reschedule a session with a minimum of 48 hours notice before the scheduled session time. Rescheduling requests must be communicated to Studify via WhatsApp or email. Rescheduled sessions are subject to tutor availability. We will make reasonable efforts to accommodate your preferred alternative time, but we cannot guarantee a specific replacement slot.
6.2 No Outright Cancellations
We do not offer outright cancellations of individual sessions. If you are unable to attend a scheduled session, you must reschedule it in accordance with Section 6.1 above. Sessions are rescheduled, not cancelled.
6.3 Forfeiture of Sessions
If a student misses a scheduled session without providing at least 48 hours notice, the session is forfeited. Forfeited sessions are not refundable, cannot be rescheduled, and do not carry over to the following month. This policy exists to protect our tutors, who prepare for and allocate time to each session.
6.4 Late Arrival
If a student joins a session late, the session will still end at the originally scheduled time. The tutor is not required to extend the session to compensate for late arrival.
6.5 Tutor Cancellations
If a tutor is unable to attend a scheduled session, we will notify you as soon as possible and offer either a replacement session at a mutually agreed time or a substitute tutor for that session. Sessions cancelled by the tutor are always rescheduled at no cost to you.
6.6 Automated Reminders
We send automated reminders approximately 1 week and 24 hours before each scheduled session. These reminders are sent as a courtesy and do not affect the cancellation and rescheduling policy. It remains your responsibility to keep track of scheduled sessions.
7. Tutor Changes
If you are not satisfied with your assigned tutor for any reason, you may request a tutor change at any time by contacting us via WhatsApp or email. There is no penalty for requesting a tutor change.
When a tutor change is requested, we will arrange a brief follow-up call to understand your feedback and ensure the next match is a better fit. We will assign a new tutor as quickly as possible, typically within 48 hours.
Please note that frequent tutor changes may disrupt your child's learning progress. We encourage giving a new tutor at least 2 to 3 sessions before requesting a change, as it can take time for a student and tutor to build rapport.
8. Satisfaction Guarantee and Refund Policy
8.1 The Studify 30-Day Satisfaction Guarantee
We offer a 30-day satisfaction guarantee on the first month of service for new clients. This guarantee is subject to the following conditions:
Condition 1: The student must have attended all scheduled sessions within the first month. If sessions were missed or forfeited due to the client's failure to provide adequate notice, the guarantee does not apply.
Condition 2: The guarantee applies only to the first month of service. It does not apply to subsequent months or renewals.
Condition 3: If the parent is not satisfied, Studify will first offer a tutor reassignment at no additional cost. The guarantee refund is only triggered if the parent remains unsatisfied after the reassignment has been attempted.
Condition 4: Refund requests must be submitted in writing (via email) within 7 days of the last scheduled session of the first month.
8.2 Refund Process
If all conditions of the satisfaction guarantee are met and the parent is still not satisfied after a tutor reassignment has been offered, we will process a full refund of the first month's payment within 10 business days. Refunds are issued to the original payment method used at the time of booking.
8.3 No Refunds Outside the Guarantee
Outside of the 30-day satisfaction guarantee described above, all payments are non-refundable. This includes but is not limited to:
Sessions that have already been delivered.
Sessions forfeited due to missed sessions or insufficient rescheduling notice.
Partial month refunds (e.g. if you decide to stop mid-month).
Single Session (Pay As You Go) bookings that have been delivered.
Bookings where the student did not attend sessions for reasons unrelated to the tutor or Studify's service.
8.4 Exceptional Circumstances
In exceptional circumstances (e.g. sustained tutor unavailability, repeated scheduling failures on our part, or significant service failures), we may at our discretion offer a partial refund, credit towards future sessions, or other compensation. Such decisions are made on a case-by-case basis and do not set a precedent.
9. Package-Specific Terms
9.1 Monthly Packages (Bronze, Silver, Gold, Platinum)
Monthly packages are prepaid on a month-to-month basis. Payment for each month must be received before sessions for that month are scheduled. Sessions do not carry over from one month to the next. If fewer sessions are used than included in the package, the unused sessions are forfeited at the end of the month.
9.2 Platinum Package Additional Terms
The Platinum package includes additional premium features as described on the website, including priority tutor matching, weekly tutor updates, a tutor retainer (up to 5 questions per week between sessions), university application guidance (for Grade 11 and 12 students), and term-end parent consultations. These features are available for the duration of the active Platinum subscription only. The tutor retainer covers brief questions and does not replace a full tutoring session. University application guidance is subject to availability and scheduling.
9.3 Single Session (Pay As You Go)
Single sessions are standalone one-off sessions with no monthly commitment. Single sessions are priced at a premium rate (R235 per session) and do not include the additional features of monthly packages (such as progress reports, exam plans, or workshop access). The cancellation and rescheduling policy in Section 6 applies equally to single sessions.
9.4 Custom Packages
Custom packages may be arranged by contacting us directly. Custom packages are subject to individual terms agreed in writing between Studify and the client. Where individual terms are not specified, these general Terms apply.
10. Free Trial Lessons
We offer a free trial lesson to new clients. The free trial is a single one-on-one session with no payment required and no obligation to purchase a package afterwards.
The free trial is subject to tutor availability and is limited to one free trial per student. If a student has multiple subjects, the free trial covers one subject only. The parent may book additional trial sessions for other subjects at the standard single session rate.
We aim to schedule free trial sessions within 48 hours of receiving the request. If we are unable to schedule within this timeframe due to tutor availability, we will notify you and provide an estimated timeline.
11. Workshops and Additional Services
Studify offers free workshops for parents, students, and tutors from time to time. These workshops are separate from the tutoring sessions and are offered at our discretion. We reserve the right to change the frequency, topics, format, or availability of workshops without notice.
Access to workshops is included with all monthly packages as a value-added benefit. This inclusion may be modified or discontinued at our discretion. Any standalone paid workshops or courses (such as university application guidance sessions) will have their own specific terms communicated at the time of purchase.
12. Client Responsibilities
As a client, you agree to:
Provide accurate and complete information when booking sessions or requesting a free trial.
Ensure that your child has access to a device with a stable internet connection, a working camera, and a working microphone for each session.
Ensure that your child is ready and available at the scheduled session time.
Communicate any changes to scheduling preferences, issues with the tutor, or other concerns in a timely manner via WhatsApp or email.
Treat tutors with respect and courtesy. We have a zero-tolerance policy for abusive, threatening, or inappropriate behaviour directed at our tutors.
Not share, redistribute, or commercially use session recordings, study materials, or other resources provided by Studify or its tutors.
Not contact tutors directly for private tutoring arrangements outside of the Studify platform. All sessions and communication should be facilitated through Studify.
13. Intellectual Property
All content on the Studify Tutors website, including text, graphics, logos, icons, images, and software, is the property of Studify Tutors or its licensors and is protected by South African copyright law.
Study materials, worksheets, exam preparation resources, and other educational content provided by tutors during or in connection with sessions remain the intellectual property of Studify Tutors or the respective tutor. You are granted a limited, non-exclusive, non-transferable licence to use these materials for the student's personal educational purposes only. You may not reproduce, distribute, sell, or publicly display these materials without our written consent.
14. Limitation of Liability
Studify Tutors provides tutoring services as a supplementary educational resource. We do not guarantee specific academic outcomes, grade improvements, or exam results. Academic performance depends on many factors beyond tutoring, including the student's effort, attendance at school, study habits, and other circumstances outside of our control.
To the maximum extent permitted by South African law:
Studify Tutors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to the use of our services.
Our total liability for any claim arising from or related to our services shall not exceed the total amount paid by you in the 3 months immediately preceding the event giving rise to the claim.
We are not liable for any technical issues, internet connectivity problems, or Google Meet platform failures that may affect session delivery, except where such issues are within our reasonable control.
Nothing in these Terms excludes or limits our liability for fraud, gross negligence, or any liability that cannot be excluded or limited under South African law.
15. Termination
You may stop using our services at any time by simply not renewing your monthly package. There is no long-term contract or cancellation fee for discontinuing services.
We reserve the right to suspend or terminate your access to our services if:
You breach any of these Terms.
Payment is not received for booked sessions.
Abusive, threatening, or inappropriate behaviour is directed at our tutors or staff.
We reasonably believe that continued service is not in the best interest of the student, the tutor, or Studify.
If we terminate your access for a reason other than a breach of these Terms by you, we will refund any prepaid and unused sessions on a pro-rata basis.
16. Force Majeure
Studify Tutors shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, pandemics, government actions, power failures, internet outages, or disruptions to third-party platforms (such as Google Meet).
In the event of a force majeure situation, we will make reasonable efforts to resume normal service as quickly as possible and will offer rescheduled sessions or credits for any sessions affected.
17. Dispute Resolution
If you have a dispute or complaint regarding our services, we encourage you to first contact us directly at the contact details below. We will make reasonable efforts to resolve the matter promptly and fairly.
If the dispute cannot be resolved informally, the parties agree to attempt mediation before pursuing any legal action. Any legal proceedings shall be governed by the laws of the Republic of South Africa and shall be subject to the jurisdiction of the South African courts.
18. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page. We encourage you to review this page periodically.
Continued use of our services after changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree with the revised Terms, you should discontinue use of our services.
19. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that most closely achieves the original intent.
20. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Studify Tutors regarding your use of our services. These Terms supersede any prior agreements, communications, or representations, whether oral or written, regarding the subject matter of these Terms.
